These Terms and Conditions govern your use of the Sailaway Vacations platform and services. Sailaway Vacations is a Belgian company acting solely as an intermediary agent for yacht charter services between clients and third-party charter providers. By accessing or using our website or services, you acknowledge and accept these terms in full.

We reserve the right to deny or suspend access to the platform at our sole discretion, especially in cases of misuse, fraudulent activity, or non-compliance with these terms.

3. Nature of uur services

Sailaway Vacations acts exclusively as a neutral intermediary. We do not own, operate, manage, or maintain any of the vessels listed on our platform. Our services consist of facilitating communication between clients and charter providers, offering general information, transmitting booking requests, and providing customer assistance during the inquiry or pre-booking process. Any contractual relationship formed for the rental of a yacht is established directly between the client and the third-party boat provider. Sailaway Vacations is not a party to such agreements and assumes no operational or contractual responsibility for any aspect of the charter itself.

4. Platform use and restrictions

You may only use this platform for personal and non-commercial purposes. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the website, its listings, or its underlying technology for commercial gain or competitive analysis. Automated scraping, data harvesting, or interference with the functionality of the platform is strictly prohibited. All intellectual property rights, including the website’s structure, content, and branding, are the exclusive property of Sailaway Vacations and may not be used without our prior written consent.

5. Information accuracy

We strive to ensure that all information presented on the platform is accurate and up to date. However, the details regarding yachts, pricing, availability, amenities, and charter terms are supplied directly by the third-party providers. We do not verify or guarantee the accuracy, completeness, or suitability of such content. Users are advised to confirm all key booking information directly with the provider before making any commitments.

6. Booking terms, payments, and cancellations

All bookings are made directly with the yacht provider and are subject to their individual terms and conditions. Payment schedules, cancellation policies, and refund eligibility are determined by the provider and will be disclosed to you prior to confirmation. Sailaway Vacations may assist in facilitating payments via secure third-party processors but is not responsible for processing errors, banking fees, currency conversion issues, or disputes arising from the provider’s terms.

Failure to comply with payment deadlines or provider-specific requirements may result in cancellation or loss of deposit. Refunds, if applicable, are governed entirely by the terms of the provider and not by Sailaway Vacations. You are advised to review all terms before finalizing any booking.

7. Insurance and risk assumption

We strongly recommend that all clients obtain adequate travel, health, and marine insurance that covers yacht charters, cancellations, accidents, and medical emergencies. Charter providers are responsible for insuring their vessels as required by law. Sailaway Vacations cannot verify the sufficiency of such coverage and is not liable for any uninsured loss or damage.

8. Liability disclaimer

As an intermediary, Sailaway Vacations is not liable for the condition, safety, or performance of any vessel or for the conduct of charter providers and their crew. We accept no responsibility for service interruptions, cancellations, non-performance, injuries, delays, or damages arising from acts or omissions by third-party providers, or due to force majeure events such as severe weather, strikes, or government restrictions. Our liability, to the extent legally permitted, is strictly limited to the service fee, if any, paid directly to us.

9. Data protection and privacy

We collect and process personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian data protection laws. Your personal information may be shared with charter providers solely for the purpose of arranging your booking. 10. Consumer Rights and EU Law

If you are a consumer residing in the European Union, you may have certain rights under EU consumer protection law, including the right to withdraw from certain contracts within 14 days and the right to remedies for non-conforming services. These rights apply to your direct contract with the charter provider. We encourage direct communication with the provider to resolve any issues. As required by EU law, we also inform you that disputes with a provider may be submitted via the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to These Terms

Sailaway Vacations reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on our website with a revised “Effective date.” Continued use of our services following such changes constitutes your acceptance of the revised terms.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Belgium. All disputes arising from or related to the use of our services shall be subject to the exclusive jurisdiction of the competent courts in Belgium. In case of discrepancies between language versions of these terms, the Dutch version shall prevail. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
